General Terms and Conditions for Private Customers (B2C)


1. Scope

These terms and conditions apply to all orders placed by private customers through our online shop. The online shop is intended exclusively for private customers. Business customers and wholesalers are excluded from use. If you are a business customer, please contact us at service@evertz-pharma.de.


2. Contractual Partner / Conclusion of Contract

The purchase contract is concluded with Evertz Pharma GmbH.

By displaying products in our online shop, we make a binding offer to enter into a contract for these items. You can place products in your shopping cart without obligation and correct your entries at any time before submitting your binding order using the correction features provided during the checkout process.

The contract is concluded when you click the order button to accept the offer for the items in your cart. You will receive an order confirmation by email immediately after submitting your order.


3. Contract Language / Storage of Contract Text

The contract language is German. We will store the contract text and send you the order data and our terms and conditions by email. For security reasons, the contract text will no longer be accessible online after the order has been completed.


4. Delivery Terms

In addition to product prices, shipping costs may apply. You can find details about shipping costs in the product offers. We deliver by mail only. Self-collection of goods is not possible. We do not deliver to packing stations.


5. Payment Methods

The following payment methods are available in our shop:


  • Prepayment: You will receive our bank details via email. The goods will be shipped after receipt of payment.

  • Credit Card: Payment will be processed immediately after placing your order, following verification of cardholder authorization.

  • PayPal / PayPal Express: You will be redirected to PayPal to complete payment. You need a PayPal account to use this option.

  • PayPal Plus: Offers payment options such as PayPal, credit card, direct debit, and invoice. Terms and further information are provided during the checkout process.

  • Sofort (Klarna): Payment via direct online bank transfer through Sofort GmbH. Requires an online banking account.

  • Amazon Pay: You will be redirected to Amazon for payment processing using your Amazon account credentials.

  • Klarna: Payment options include invoice, installment payments, direct debit, and credit card. Terms and conditions of Klarna apply. For more information, refer to Klarna's website.


6. Retention of Title

Goods remain our property until full payment has been received.


7. Transport Damage

If goods are delivered with obvious shipping damage, please report this to the carrier immediately and contact us without delay. Failure to report damage does not affect your legal warranty rights but helps us assert claims against the shipping company.


8. Warranty and Guarantees

Unless otherwise expressly agreed, statutory warranty rights apply. The warranty period for used goods is one year from delivery.

Exclusions to this limitation apply to damages caused by:


  • Injury to life, body, or health,

  • Intentional or grossly negligent breaches of duty,

  • Breach of essential contractual obligations (cardinal duties),

  • Product liability claims under applicable law.

9. Liability

We are liable without limitation for damages resulting from:


  • Injury to life, body, or health,

  • Intentional or grossly negligent breaches of duty,

  • Guarantees, if provided,

  • Product liability law.


For breaches of essential contractual obligations due to slight negligence, our liability is limited to foreseeable damages typical for this type of contract. Otherwise, claims for damages are excluded.


10. Dispute Resolution

We are willing to participate in out-of-court dispute resolution proceedings before a consumer arbitration board.


11. Resale

Commercial resale of products purchased through our online shop is strictly prohibited.
